The Misuse of Drugs Act 1971 contains the law on drugs within the UK, but these cases are usually very complicated. The seriousness of the offence generally depends on two main factors:
- The type of drug found
- The extent of the person’s involvement with that drug
If you or a family member have been arrested on a drug-related charge, you should contact our specialist drug offence lawyers in London or Belfast today for expert advice.
About drug offences
The authorities and the courts take drug offences very seriously. As previously mentioned, the seriousness of each charge varies greatly due to the substance found and the type of involvement the person has had with that substance. The punishment may be a fine or worse, imprisonment.
According to the NHS, official statistics, ‘around 1 in 11 (9.4%) adults aged 16 to 59 had taken a drug in the last year, which equates to about 3.2 million’.
Therefore, it is clear that not all people involved in drug-related cases can be classified as your normal ‘criminal’. The misuse of substances affects a lot of people from all backgrounds and we deal with each case in a way that is sensitive to everyone’s personal situation.
Types of illegal drugs
Illegal drugs can be split up into three classifications, A, B and C, with Class A being viewed as the most serious.
Examples:
- Class A: Ecstacy, Cocaine, Heroin, LSD, Methamphetamine
- Class B: Cannabis, Amphetamines
- Class C: Anabolic Steroids, Ketamine, Tramadol
Types of drug offensives
Another factor that has a huge impact on how a drug offence will be dealt with, is the involvement of the defendant with that substance. Below are many examples of levels of involvement with drugs:
- Possession of drugs
- Possession of drugs with an intent to supply
- Dealing drugs
- Drug trafficking
- Drug importation
- Drug exportation
- Drug production
- Driving under the influence of drugs (dui)
